New York Construction Worker Falls to His Death
A construction worker’s first day on the job should be cause for celebration at the end of the day. Sadly, for one Brooklyn construction worker, his first day on the job was his last day after he fell to his death. New York Construction Worker Electrocuted
A New York construction worker was fatally injured in a recent workplace accident. According to reports, the 47-year-old construction worker was working in East Greenbush, approximately150 miles north of Manhattan, when the accident happened. The worker was employed by a paving company and was lowering a light tower at the time the accident happened. Apparently, the tower made contact with overhead power lines, setting off a fatal burst of electricity. Witnesses to the accident said the victim was consumed by the ensuing fire before anyone could do anything to help. [Read more…]
When Is Someone Legally Responsible For Your Injury?

“Before recovery may be had, a duty must exist in law, and a failure in that duty must be proved as a fact.” Mergel v. Colgate-Palmolive-Peet Co., 41 N.J. Super.372, 379 (App. Div. 1956). There can be no recovery in a negligence action if the actor violated no duty owed to the injured party. Karuth v. Geller, 54 N.J. Super.442, 453 (App. Div. 1959). Furthermore, “negligence is tested by whether the reasonable, prudent person at the time and place should recognize and foresee an unreasonable risk or likelihood of harm or danger to others.” Rappaport v. Nichols, 31 N.J. 188, 201 (1959).Therefore, the standard of care must be that of “a reasonable person of ordinary prudence” under the same or similar circumstances.” Butler v.
